On July 20, 2018, the Bureau of Real Estate filed an accusation, no. H-12178, against DeWolf Realty Company and its designated officer, George Martin Green. Both DeWolf and Green are accused of audit violations. Green is accused of an additional count of failure to supervise.
According to the accusation, on or around November of 2016, the Bureau of Real Estate began an audit when a complaint alleging that an unlicensed individual was permitted to perform property management activities was received. During the time the audit was conducted, Respondents received or accepted funds in a trust and deposited those funds into six bank accounts. Respondents failed to maintain and/or keep accurate and complete control of records for at least five disbursements of the primary bank account. Respondents also allowed six unlicensed signatories authority to withdraw from bank accounts and allowed the amount of funds in two bank accounts to be reduced less than the aggregate liability. Respondents were also accused of allowing two unlicensed individuals to engage in activities that require a real estate license and were compensated either directly or indirectly. Finally, respondents failed to disclose the eight-digit license number on the website.
Green was also accused of failing to exercise reasonable supervision and control over the real estate activities of DeWolf by allowing the above violations to happen.
On September 13, 2019, DeWolf Realty Company entered into an agreement with the Bureau of Real Estate. According to the settlement, respondents’ licenses are revoked but may apply for a restricted license, if they meet the required criteria. They are furthermore not eligible to petition for the issuance of a non-restricted license or remove any of the conditions until two (2) years have elapsed from the effective date. They are also order to pay $8,106.10 for the cost of the investigation and $9,409.11 for the cost of the audit.
