On January 14, 2021, the County of San Mateo, filed a complaint for Injunctive Relief, Abatement of Nuisance and Payment of Fines (case: 21-CIV-00174), against Pacifica Beach Yoga.
The action stems from Pacifica Beach Yoga and owner Thomas Antoons’ having remained open for indoor yoga services and failing to require employees and patrons to wear face coverings despite orders requiring individuals to wear face coverings while in door public spaces and a regional stay-at-home order that requires the closure of indoor gyms, fitness centers and yoga studios.
The action states in part that “The public nuisance created by Defendants, and each of them, as alleged herein, unless enjoined and restrained by the Court, will cause and continue to cause great and irreparable injury to the general public, including all persons within San Mateo County, by creating a significant risk of further community spread of COVID 19, including hospitalizations and deaths.”
On January 21, 2021, the County of San Mateo submitted an application for a restraining order. The action was taken because the defendants have repeatedly ignored prohibition and limitations imposed by public health orders and of the immediate threat to public health and safety.
The restraining order prohibits the defendants from hosting classes or gathering that do not comply with both state and county health orders which include allowing participants to attend any gathering, including classes without wearing face coverings and enforcing adequate social distancing. A hearing has been set for February 4, 2021
