    New Mexico v. Moore, et al.

    The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government's allegations, which have not yet been proven.

    On December 20, 2016 a complaint was filed against Thomas A. Moore by the State of New Mexico Attorney General, in the U.S. District Court of New Mexico. The complaint alleges Moore participated in a scheme that targeted and misled New Mexico homeowners following the 2008 foreclosure crisis. Defendants fraudulently used the name "Keep Your Home New Mexico," a homeownership preservation program developed and funded by the National Mortgage Settlement, and advertised in a way that portrayed themselves as having governmental authority and lender cooperation. The company is alleged to have violated consumer protection statutes by using deceptive and unlawful marketing, sending mass mailings that failed to provide required notices and disclosures, and taking up-front fees.

    Deleware Department of Justice v Thomas Moore Esq

    The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.


    On July 10, 2019, Thomas Moore Esq entered into a Cease and Desist Agreement with the Delaware Department of Justice. The Agreement settles allegations that Thomas Moore Esq. offered mortgage loan modification services without being registered with the state or paying the required surety bond. The contracts given to consumers didn’t contain a place for the consumer to initial each page of the agreement, fully disclose the exact nature of the modification services to be provided and the total amount and terms of compensation to be received, or include a provision allowing the consumer to cancel. The contract also didn’t include mandatory disclosures. Thomas Moore advised consumers not to communicate with their mortgage lenders or servicers, received or requested payments from Delaware consumers without first obtaining mortgage loan modifications from their mortgage lenders or servicers, and misrepresented the nature, necessity and quality of their services to Delaware consumers. Thomas Moore misrepresented that Delaware consumers would qualify for loan modifications from their mortgage lenders and the business had the ability to achieve such modifications. They also misrepresented their association with the government programs by using misleading logos and citations. Under terms of the Assurance, Thomas Moore agreed to cease and desist from violating the Delaware Mortgage Loan Modification Services Act, Delaware Consumer Fraud Act, and the Delaware Trade Practices Act. Thomas Moore is prohibited from mortgage loan modification services, assisting others from any form of mortgage loan modification services, and any legal services related to mortgage loan modification, mortgage foreclosure relief or debt relief in the State of Delaware. Thomas Moore agreed to pay $70,000 in civil penalties, $55,000 shall be suspended and will become immediately payable upon a material violation by the business. Thomas Moore shall pay a total of $22,475 in restitution. The Assurance was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law.
