    Federal Trade Commission/Facebook Settlement

    On July 24, 2019, a settlement was reached between the Federal Trade Commission (FTC) and Facebook (case 1:19-cv-02184).

    According to the settlement, Facebook is ordered to pay a penalty of $5 billion-dollars. In addition, Facebook will be required to exercise greater oversight over third-party apps, will be prohibited from using telephone numbers obtained to enable a security feature, (e.g., two-factor authentication) for advertising, must provide clear and conspicuous notice of its facial recognition technology (tagging), and obtain affirmative express user consent prior to any use that materially exceeds it’s prior disclosures to users. Facebook must also establish, implement and maintain a comprehensive data security program, encrypt user passwords as well as regularly scan to detect whether any passwords are stored in plaintext, and will be prohibited from asking for email passwords to other services when consumers sign up for its services.

    The 20-year settlement order also states that a privacy committee independent of Facebook’s CEO be established to oversee decisions affecting user privacy, and to designate compliance officers who will be responsible for Facebook’s privacy program. These officers will submit to the FTC quarterly and annual compliance certifications showing that the company is in compliance with the privacy program mandated by the order.    

    The settlement stems from FTC’s findings that Facebook violated a 2012 settlement by deceiving its users when the company collected and shared the data of users’ Facebook friends with third party app developers and among other things, misrepresented users’ ability to control the use of facial recognition with their accounts; users believed they would have to opt-in to have this service enabled, when in fact the setting was turned on by default. Facebook is also alleged to have violated the FTC Act’s prohibition against deceptive practices when users were told the purpose of collecting phone numbers was to enable a security feature, but did not disclose the numbers were also used for advertising purposes.

    On April 23, 2020, the Federal Trade Commission formally approved amendments (Docket No:C-4365) to its 2012 order against Facebook to include the provisions that were incorporated in the 2019 settlement.
