On August 4, 2020, The Federal Trade Commission filed a Complaint against QYK Brands LLC, dba Glowyy, Rakesh Tammabattula (CEO), and Jacqueline Thao Nguyen (COO). Charges filed allege the business is in violation of federal law prohibiting the dissemination of any false advertisement in or affecting commerce for the purpose of inducing the purchase of food, drugs, devices, services, or cosmetics, making deceptive shipping claims, making deceptive COVID-19 prevention claims, and making false establishment claims. The business began advertising hand sanitizer, masks, face shields, and other products online. They stated the products were in stock and would ship the same day they were ordered. The business failed to actually give the product to the post office for shipping and failed to offer refunds to consumers or allow them to consent to the delay as required by the Mail Order Rule. The business also made unfounded claims about the ability of a product called “Basic Immune IGG” to treat or prevent COVID-19. They claimed the product could prevent transmission of COVID-19 and had been approved by the US Food and Drug Administration.
The matter is pending.
