On May 17, 2023, BBB requested Flex Focus Glasses to modify, substantiate, or discontinue claims on their website (https://shop.topflexfocus.com/page/inter/7C1601FA#overview) that read: “Developed by top optical scientists” “Sell Out Risk: Almost Sold Out!” The website advertises mark-down prices without displaying an end date to the sale and displays as seen on “ABC News, DailyMail, LAD Bible, Insider, and Forbes.”
Advertisers must be prepared to substantiate such claims per BBB's Code of Advertising.
BBB’s Code of Advertising section 9 Sales states: Retailers can advertise “sales” where they are offering a significant reduction in price for a limited period of time. At the end of the sale period, retailers can, in good faith, convert the sale price to a new regular price if they no longer claim savings.
BBB's Code of Advertising section 10 "Emergency" or "Distress" sales states: Emergency sales must be for a limited period of time, and only include products that are affected by the emergency. The reason given for the sale must be true. Advertisers stating they are closing out a particular product can do so where the advertiser will no longer carry that product.
