The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the governments allegations, which have not yet been proven.
On January 27, 2021, The Federal Trade Commission filed a Stipulation to Enter Order for Permanent Injunction and Monetary Judgement against La Posta Tribal Lending Enterprise dba Gentle Breeze Online. Charges filed allege the business is in violation of federal law prohibiting failing to make required loan disclosures, making recurring withdrawals from consumers' bank accounts without proper authorization, and illegally using remotely created checks. The business used deceptive marketing tactics to convince consumers that their loans would be repaid in a fixed number of payments. In fact, in many instances, the FTC alleges, consumers found that long after the promised number of payments had been made, the defendants had applied their funds to finance charges only and were continuing to make regular finance-charge only withdrawals from their checking accounts. Under terms of the settlement, the business will be permanently prohibited from making loans or extending credit of any kind. The settlement includes a monetary judgment of $114.3 million, which is partially suspended based on an inability to pay. The defendants will be required to turn over all corporate assets and almost all domestic personal assets along with a number of vehicles to a receiver. The receiver will wind down and liquidate the business and provide all proceeds to the FTC.
