- Advertising Review:On February 3, 2022, BBB requested BarxBuddy to substantiate, modify or discontinue claims on their website, "https://www.barxbuddy.com/" that read: "30 Money Back Guarantee" and lists discounted prices. In addition, BBB advised the business that a Privacy Policy should be included on their website since the business is collecting sensitive information from customers. Advertisers must post a privacy policy per California law if the website is collecting personally identifiable information from customers.
BBB's Code of Advertising Section 1 Basic Principles of the Code states advertisements should be truthful, sincere offers to sell. Advertisers have a responsibility to have substantiation for all claims made and should be able to provide that substantiation upon request. All advertising that may mislead or deceive consumers should be avoided. BBB's Code of Advertising Section 5 Comparison with the current price of comparable products or services sold by the advertiser or by others states advertisers must be reasonably certain that the compared to price does not appreciably exceed the price at which substantial sales for the comparable product have been made. Additionally, BB's Code of Advertising Section 20 Warranties or Guarantees states when using the term “warranty” or “guarantee” the advertiser should clearly and conspicuously include a statement that the complete details of the warranty can be seen prior to the sale which could include putting it on the seller’s website. Advertisers should disclose any material limitations on a "satisfaction guarantee" or "money back guarantee" and define, for consumers, the meaning of claims such as "lifetime guarantee."
