On February 14, 2024, BBB contacted the business regarding claims made on its website and online advertising and requested they be substantiated, modified or discontinued.
The business advertises “Up to” price savings (for example, “save up to 50%”). BBB’s Code of Advertising states that when a business offers an "up to" savings; the inventory available at the maximum savings must comprise a significant percentage, at a minimum 10%, of all the items in the offering, unless local, provincial law requires otherwise. BBB was unable to substantiate that the available inventory comprises a minimum of 10%.
The business advertises a price match guarantee. BBB’s Code of Advertising states that the offer should be made in good faith, include all necessary information to take advantage of it, and not place unreasonable burdens on the consumer who wants to take advantage of the offer. BBB was unable to locate the terms and conditions of this offer.
The business offers sales such as 25% off and No Tax. BBB’s Code of Advertising states that sales should only last for a limited period of time. BBB was unable to locate an expiry date on these offers.
The business advertises a “Guarantee” and “Warranty” but BBB could not locate any details or where these could be viewed. BBB’s Code of Advertising states when using the term “warranty” or “guarantee” the advertiser should clearly and conspicuously include a statement that the complete details of the warranty can be seen prior to the sale which could include putting it on the seller’s website.
The business advertises original pricing on the majority of items which have been slashed and a lower price is advertised underneath, which implies savings. According to the BBB Code of Advertising, the former price must be the actual price at which the advertiser has openly and actively offered the product or service for sale, for a reasonably substantial period of time, in the recent, regular course of business. BBB was unable to verify if the former prices were actively offered for a substantial period of time.
The business advertises “SEE IN-STORE FOR SPECIAL PRICING” and “Special Buy”. BBB attempted to obtain further elaboration but were not successful. BBB’s Code of Advertising states that advertisers have a responsibility to possess substantiation for all claims made and should be able to provide that substantiation upon request.
The business did not respond to BBB’s requests.
