West Virginia Attorney General vs Judy's Drug Store Inc

The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below

The Attorney General of West Virginia has been investigating certain acts and practices of Judy's Drug Store which resulted in a civil action being filed before the Hardy County Circuit Court. In accordance with West Virginia Consumer Credit and Protections Act. The company, without in any way admitting or agreeing that any of its prior practices were in violation of the WV Consumer Credit and Protection Act or other applicable laws, consents to observe the following terms, conditions, and agreements in the future conduct of its business in West Virginia from and after the date of this Assurance of Discontinuance. 

Judy's Drug Store, its employees, agents, servants, heirs, successors, and assigns do hereby promise and voluntarily assure the Attorney General that it will comply with the Act, W. Va. Code § 46 A- 1-101 et seq., the West Virginia Controlled Substances Act, see id. §§ 60A-1-101 el seq., and other applicable laws and regulations and to follow the "Best Practices for Dispensing Opioids in West Virginia. Judy's Drug Store agrees not to represent directly or indirectly, or in any manner whatsoever, that the Attorney General has sanctioned, condoned or approved, in any manner whatsoever, any part or aspect of its business operation, unless written authorization is obtained. 

By execution of this Assurance, the Attorney General releases Judy's Drug Store from all civil claims, causes of action, damages, restitution, fines, costs, penalties and attorney fees under W. Va. Code § 46A- 1-101 et seq., or other applicable laws arising from any conduct that is the subject of this Assurance or could have been asserted by the Attorney General against Judy's Drug Store in his action against Judy's Drug Store based on its alleged activities, whether asserted or not asserted, or specified herein above.

The Attorney General agrees that he will not take further action against Judy's Drug Store for the matters underlying this Assurance unless the Attorney General determines that compliance with the terms of this Assurance are not being materially observed or if any representation made by Judy's Drug Store and reflected herein are found to be materially untrue.

It is agreed and understood that the contents of this Assurance are and shall be public information. It is expressly understood and agreed that this Assurance does not constitute an admission of any kind of improper or unlawful conduct, improper or unlawful acts, or improper or unlawful practices, and that the agreements contained herein are being made solely and only to resolve and compromise disputed claims between the Attorney General and Judy's Drug Store.
