Government Action

Case 3:20-mj-05097-JRC United States of America vs Richard Marschall

The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the governments allegations, which have not yet been proven.

On April 29, 2020, in the United States District Court for the Western District of Washington at Tacoma, the United State of America entered a Complaint for Violation of Title 21, United States Code, Sections 331 and 332 against Richard Marschall charging Marschall with one count of introducing a misbranded drug into Intrastate Commerce.

On or about March 31, 2020, at Port Angeles, within the Western District of Washington, and elsewhere, RICHARD MARSCHALL, after having been convicted of a violation of Title 21, United States Code, Sections 331(a) and 333(a)(2), did introduce, deliver, and cause the introduction and delivery for introduction into interstate commerce, from Port Angeles, Washington, to locations outside of Washington State, of drugs, to wit: Allimed and IAG Arabinogalactans, which were misbranded as defined at: Title 21, Section 352(f)(1) in that the drugs lacked adequate directions for use and were not exempt from this requirement; Title 21, Section 352(a) in that the drugs were falsely and misleadingly labeled in any particular; and Title 21, Section 352(o) in that the drugs were manufactured in an establishment not registered with the Food and Drug Administration as a drug manufacturer and not included in any list of drugs manufactured in a registered establishment, as required by 21 U.S.C § 360(j). All in violation of Title21, United States Code, Sections 331(a) and 333(a)(2). And the complainant states that this Complaint is based on the following information:

On October 9, 2018, RICHARD MARSCHALL’s credential to practice as a naturopathic physician in the state of Washington was permanently revoked, with no right to reapply, by the Washington Secretary of Health, based on a finding that due to MARSCHALL’s criminal and professional history, he “cannot be rehabilitated, nor can he regain the ability to practice with reasonable skill and safety,” and finding as aggravating factors the “Gravity of the unprofessional conduct. . . . Failure to comply with multiple Agreed Orders, and state and federal court orders. . . . [and the] Number or frequency of the acts of unprofessional conduct.”

On March 26, 2020, the FDA-Office of Criminal Investigations initiated an investigation into RICHARD MARSCHALL, of Port Angeles, Washington, after receiving multiple complaints regarding Facebook postings by MARSCHALL and others about a product called “the Dynamic Duo,” represented by MARSCHALL as being able to kill viruses, including the aforementioned Coronavirus disease.

On March 8, 2020, the person controlling the Rick Marschall Facebook Page posted: “Plant Based powerful Allimed & IAG to prevent or treat viral, bacterial, fungal and parasitic infections.” The post continued “The Good News is that there are 2 products that I’ve recommended that are ENTIRELY plant based, that can boost the immune system so it can fight for you but even more importantly while your immune system is being strengthened, can crush, 30 different viral infections including those in the Corona family like in China, 40 different bacterial infections, 25 different fungal infections and 20 different parasitic infections like amoeba.”

On March 9, 2020, the person controlling the Rick Marschall Facebook Page posted:“ Taking Allimed, my brand releases 450mg of allicin and is powerful enough to reduce or eliminate most viruses, bacteria, parasites, MRSA, and yeast even if there is antibiotic resistance. Allicin does not kill good bacteria so it can be taken right along with your probiotic.”

A package was purchased undercover.  The undercover credit card was charged in the amount of $149.50 by “NATURAL HEALING CLINIC PORT ANGELES WA.” The package contained the following items:  Allimax® Pro (Allimed) and IAGTM Arabinogalactans distributed as the “Dynamic Duo,” an invoice and sales receipt along with documents titled “The Dynamic Duo Instructions,” “Preparing for Viral Infections with Plant Medicines Since Antibiotics Can’t Help, Introducing the “Dynamic Duo” by Rick Marschall N,D.”, and “”BE PREPARED” Virus Dynamic Duo By Rick Marschall, Health Coach, ”which stated that these two products“ can crush 30 different viral infections, including those in the Corona family, (like in China Corona-19), 40 different bacterial infections, 25 different fungal infections and 20 different parasitic infections like amoebas.”

The label of the Allimax Pro® indicates that it is manufactured by Allimax Nutraceuticals US, 500 W. Superior St., Suite 2205, Chicago, Illinois 60654.  A search of the FDA Drug Establishment Database for the business Allimax Nutraceuticals did not return any drug manufacturing establishments registered.  No registered drug establishment lists Allimax Pro® as a drug it manufactures in their establishment. Although the immediate label of Allimax Pro® does not state that the product can kill viruses including those in the Corona family, like in China Corona-19, the accompanying labeling MARSCHALL added to the shipment does make this intended use claim. 25. The label of the IAGTM Arabinogalactans indicates that it is manufactured by Biotics Research Corp, 6801 Biotics Research Drive, Rosenberg, Texas 77471.  A search of the FDA Drug Establishment Database for the business Biotics Research Corp identified the business as having previously been registered as a homeopathic drug manufacturer; however, neither Biotics nor any other registered drug establishment has listed IAG Arabinogalactans as a drug it manufacturers in their establishment.  The immediate label does not state the product can kill viruses including those in the Corona family, like the China Corona-19, however the accompanying labeling Marschall added to the shipment does make this intended use claim.
