State of Washington Utilities and Transportation Commission v Airus Movers LLC
The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.
On September 9, 2024, the State of Washington Utilities and Transportation Commission issued a $15,600 penalty to Airus Movers LLC, a household goods moving company offering services in Seattle and the surrounding areas for over 200 safety violations found during a routine safety investigation.
During the investigation, staff identified 202 violations of driver and vehicle safety rules committed by Airus Movers LLC. Staff found that Airus Movers failed to complete criminal background checks for nine employees and allowed three drivers to operate without a valid medical certificate on 143 occasions.
UTC staff also discovered that Airus Movers LLC failed to require four drivers to prepare a record of duty status on 42 occasions. The remaining critical violations were related to the company’s failure to maintain driver qualification and vehicle maintenance records.
The UTC is authorized to assess a penalty of up to $100 for each critical violation, resulting in a total penalty of $15,600.
A letter was sent to Airus Movers LLC requesting the company submit a safety management plan (SMP) to address the violations. Airus Movers submitted a plan; however, it did not meet legal requirements.
On October 21, 2024, the Commission Ordered the following:
(1) Airus Movers LLC is held in default. Should Airus Movers fail to respond to this Order by filing a written motion within ten (10) days requesting that the order be vacated pursuant to WAC 480-07-450(2), the default in this proceeding shall remain in place.
(2) Airus Movers LLC’s operating permit as a household goods carrier is deemed canceled.
(3) Airus Movers LLC is assessed a penalty of $15,600, which was past due and must be paid immediately.
(4) Airus Movers LLC is ordered to immediately cease and desist operations as a household goods carrier within the state of Washington.
