Utah DCP vs. SUPERIOR HOME IMPROVEMENT INC.
On 09/29/2018 the business entered into a Settlement Agreement with the Division of Consumer Protection. The Assurance settles allegations that the business:
i. One count under Utah Code § 13-25a-108 for making or causing to be made an unsolicited phone call within Utah to a telephone number contained in the no-call database established under section i3-25a-109; and
ii. One count under Utah Code § 13-1 l-4(2)(i) for indicating to the consumer that Respondents were affiliated with Dominion Energy when they were not, and for representing to the consumer that Dominion Energy asked SHI to call the consumer when that was not the case.
Under terms of the Assurance, the business agreed to Cease and Desist from any other violations of the e Telephone and Facsimile Solicitation Act or the Utah Consumer Sales Practices Act and also to pay a fine of $1,000.00 to Division of Consumer Protection. The Assurance was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law.
