BBB promotes truth in advertising by contacting advertisers whose claims conflict with the BBB Code of Advertising. These claims may come to our attention from our internal review of advertising, consumer complaints, and competitor challenges. BBB asks advertisers to prove their claims, change ads to make offers more clear to consumers, and remove misleading or deceptive statements.
On September 27, 2022, BBB contacted Cashing Homes LLC regarding an advertisement on their website https://www.cashinghomes.com/about-me stating "We can solve 90% of legal issues related to your house as part of the sale, most of the time for free."
BBB Code of Advertising states the primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB.
BBB requested Cashing Homes to substantiate the claim by providing a written response to how consumers’ legal issues would be resolved through a sale.
Cashing Homes LLC discontinued the advertisement.
Cashing Homes also advertises testimonials on their website.
BBB Code of Advertising states in general, advertising which uses testimonials or endorsements is likely to mislead or confuse if it is not genuine and does not represent the current opinion of the endorser. If a consumer’s experience represented in an advertisement is not the typical experience of those using the product or service unless the advertisement clearly and conspicuously discloses what the expected results will be.
BBB requested Cashing Homes LLC to disclose and substantiate the typical result from customers’ testimonials and substantiate the testimonials with scientific evidence if available of the common result advertised. If they could not substantiate that customer testimonials express the common experience of your products and services BBB requested, Cashing Homes LLC clearly and conspicuously disclose the possible outcomes including:“These testimonials are based on the experiences of a few people, and you are not likely to have similar results” or
“Results claimed by our customers below are based on individual experiences that are unique and cannot be guaranteed.”Cashing Homes LLC modified its website by adding a disclaimer that the results claimed by its customers are based on individual experiences that are unique and cannot be guaranteed.
