On December 4, 2018, Bains Brothers, LLC, entered into a settlement agreement with the Texas Office of Attorney General (TX OAG) Consumer Protection Division. The settlement resolves allegations that when the Governor of Texas declared a state of disaster for 30 counties anticipating landfall of Hurricane Harvey, two of Bains Brothers' gas stations engaged in price gouging by charging excessive prices far beyond market fluctuations.
TX OAG Consumer Protection Division received complaints from consumers alleging that the stations were charging up to $6.99 per gallon of regular grade unleaded gasoline during the Harvey State of Disaster.
Under terms of the settlement, the business will refund eligible consumers who paid $3.99 per gallon or more for unleaded gasoline on August 31, 2017 at two of the company's gas stations: 3600 Huffines Boulevard in Carrollton, Texas and 2809 NW Green Oaks Boulevard in Arlington, Texas.
Furthermore, the business shall refrain from 1) collecting or attempting to collect a price per gallon of fuel that is other than the price posted at the fuel pump, 2) collecting or attempting to collect a price per gallon or fuel other than the price posted on signage located at or near the dispensing pump or visible from the street and 3) demanding an exorbitant or excessive price for fuel or selling fuel at an exorbitant or excessive price during a State of Disaster.
Bains Brothers agrees to pay $26,250 in consumer restitution and $10,000 for attorney's fees and court costs.
This final action was for settlement purposes only and should not be considered an admission of guilt or finding of violation of the law.
