The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency.
On October 11, 2023, the Pennsylvania Attorney General’s Bureau of Consumer Protection (BCP) announced it had entered into an Assurance of Voluntary Compliance (AVC) with Rutter’s settling alleged violations of Pennsylvania’s Unfair Trade Practice and Consumer Protection Law. Specifically, the AVC settled allegations that the company, in 2018 and 2019, failed to use appropriate information security practices to protect its customers’ payment card information, and, as a result, a hacker was allegedly able to obtain information related to at least 1.3 million payment cards used over the course of 272 days at 29 store locations. As part of the settlement, Rutter’s agreed to pay $1 million, improve security measures via an independent assessment, conduct and document a risk assessment, undergo an independent settlement compliance assessment, and implement security improvements.
