Government Action: BBB reports on known government actions involving business’ marketplace conduct:
Pennsylvania Attorney General Files Lawsuit Against Gillece Services

The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government’s allegations, which have not yet been proven. 


On September 1, 2020 the Commonwealth of Pennsylvania, Office of Attorney General filed a Complaint against Gillece Services, LP, Gillece Plumbing, Heating, Cooling and Electrical Inc., Gillece Plumbing and Heating, Inc., Rooter-Medic and Electric Medic and individually against Thomas J. Gillece,  former Gillece Services LP service manager James F. Hackwelder and field supervisor Joseph A. Nikoula. The Complaint alleges, in part, that the defendants are using, have used or are about to use methods, acts or practices declared unlawful by Section 201-3 of the Consumer Protection Law.


The Complaint follows an investigation in which the Attorney General’s Bureau of Consumer Protection alleges, in part, that the defendants are engaged in a widespread bait and switch scheme designed to defraud Southwestern Pennsylvanians into unnecessary (and costly) home improvement work - particularly unnecessary sewer pipe replacements. It also claims they often utilize high pressure sales and scare tactics to get consumers to sign contracts for unnecessary work. 


Furthermore, Gillece advertise their home improvement goods and services in a highly deceptive manner, including by making materially false and/or misleading statements in their advertising materials and by failing to disclose material information, including a multitude of terms and restrictions on advertising offers.


In December 2015, the Complaint states that the Corporate Defendants were sent a warning letter by the Office of Attorney General that certain business practices were in violation of the Home Improvement Consumer Protection Act (HICPA) and the Consumer Protection Laws after the parties met in October 2015. Amongst the concerns in the warning letter were the misdiagnoses of consumers’ home improvement problems and/or the recommendations of unnecessary home improvement work; the use of scare tactics to induce consumers to sign contracts; and failure to disclose material information to consumers in the course of offering and/or contracting for home improvement work.


The Complaint states that the Defendants violated the Section 201-3 of the Consumer Protection Law by knowingly misrepresented to consumers’ plumbing, heating, cooling of electrical equipment were in need of servicing, replacement, and/or repairs when servicing, replacement and/or repairs were not needed; made material misrepresentation and/or material omissions of fact to consumers in connection with the sale of goods and/or services; and made materially misleading statements to consumers in connection with the sale of goods and/or services.


In response to these charges, Gillece Services provided the following statement, "As a local, family owned business that employs 70 people in the Pittsburgh area, we disagree with the false assertions made by the Office of Attorney General. We intend to vigorously contest those assertions."

Pattern of Complaint

On August 10, 2020 BBB corresponded with Gillece Services regarding a pattern of BBB complaints: 

BBB files indicate this business has a pattern of complaints concerning consumers alleging issues with Customer Service, Service, and Sales. Consumers claim that they felt high pressure sales tactics were used to get them to agree to expensive repairs. Several customers state they were told they had terra cotta pipes that needed to be replaced, only to find out they actually had PVC pipes. Consumers allege that employees caused damage while attempting to do repairs. Customers state that they tried to schedule appointments for repairs, but that the appointments were repeatedly rescheduled, or that no one showed up. Consumers state that they tried to contact the company about their concerns, but that their calls were not returned.

On August 31, 2020 the company responded:

Gillece Services considers complaints very serious and is actively making changes to eliminate them. We have recently onboarded a customer liaison who is responsible for updating customers throughout the day and doing follow-up calls after services performed to ensure the customer is satisfied. 
When a customer has to be rescheduled we are now offering anywhere from $50-$150 credit towards any future work with Gillece Services. 
If a customer isn't satisfied with our work, or any damages that may have occurred during our visit, we send someone else out to correct the issue within a reasonable time frame.
If a customer calls in with a concern the company will return their call within 24 hours and will take the necessary course of action to correct the issue. 
Gillece Services is now both members and certified with NASSCO (The National Association of Sewer Service Companies). It is a privately-held for-profit North American trade organization, established in 1976 "to increase the awareness of aging underground infrastructure and to provide viable solutions through education, technical resources and industry advocacy". NASSCO's intent is to research, train and educate members and non-members on rehabilitation of underground utilities using trenchless technology. Ultimately, NASSCO is committed to set the "industry standards for the rehabilitation of underground pipelines, and to assure the continued acceptance and growth of trenchless technologies". Included in the NASSCO training and inspection standards is the NASSCO scoring scales regarding the structural integrity of the pipe, which is comprised of the Structural, Operations and Maintenance of the pipeline itself. So far we have multiple sewer technicians that have completed the training and certification.
