The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the governments allegations, which have not yet been proven.
On Nov. 7, 2024, the Ohio Attorney General's Office filed a civil lawsuit in Franklin County Common Pleas Court against defendants Tennielle Young and TracysCollections LLC, alleging the defendants committed unfair and deceptive consumer sales practices, accepted money from consumers, promised consumers that they would ship clothing and related goods, failed to deliver some goods, failed to provide some requested refunds, misrepresented to some consumers that they would eventually receive their goods, blocked some consumer numbers and accounts when consumers attempted to contact defendants about the status of their orders. According to the lawsuit, defendant Young has also allegedly demonstrated a pattern of repeatedly operating under new business names to continue to commit violations of Ohio's consumer protection laws. Prior to forming TracysCollections LLC, defendant Young operated a substantially similar business through the business name B Younique Boutique, and on Sept. 26, 2019, the Ohio Attorney General filed a lawsuit against defendant Young alleging that she had violated the Consumer Sales Practices Act in connection with her online sales of clothing and related goods using the business name B Younique Boutique, and in that previous lawsuit the court granted a default judgment and defendant Young was ordered to pay $491 in consumer damages and a $1,000 civil penalty, and was enjoined from engaging in further violations of the Consumer Sales Practices Act, and while defendant Young settled the amount due, in the time since then, defendant Young registered the new company TracysCollections LLC and continued to sell clothing and related goods online but has not ceased the practices found to be in violation of the primary judgment, according to the current lawsuit. In the current lawsuit, the state is seeking consumer restitution, civil penalties, and an injunction prohibiting the defendants from engaging in business in any consumer transactions in Ohio until they have satisfied all obligations ordered pursuant to the current litigation.
