Peak Construction Services is owned by Mr. Jacob Wagers, who is also identified in BBB files as the owner of Madison Roofing, and Premier Claims Solutions, LLC.
According to a government action in the Butler County Clerk of Courts on April 14, 2017, the Ohio Attorney General filed a complaint against Mr. Wagers, dba Premier Claims Solutions, LLC. The complaint alleged that Wagers violated Ohio's consumer protection laws by not delivering on services for which he took payments, and refusing to accept cancellations or refunds.
On December 1, 2017 the court ordered that Mr. Wagers is permanently enjoined from soliciting consumers either directly or indirectly and entering into contracts for home remodeling and repair services for a fee.
Government Actions
State of Ohio v. Peak Construction Services, LLC
On January 20, 2020, the Ohio Attorney General filed a suit in Butler County, Ohio alleging Peak Construction Services, LLC accepted deposits from consumers for of home improvement goods and services and failed to deliver within 8 weeks, refused to refund deposits, and produced incomplete or substandard work. The suit seeks reimbursement to all affected consumers, as well as a civil financial penalty.
On October 27, 2020, the Court ordered a default Judgment that allows for the Ohio Attorney General to submit testimony by affidavits regarding the damages suffered by consumers. It was also ordered that upon a filing of memorandum in support of damages, the Court will consider the request for consumer damages and civil penalties.
On February 24, 2021, the Court granted the Ohio Attorney General's Motion for Damages as to Judgement for $16,462.89 in restitution as well as a civil penalty of $25,000.00.
