BBB develops reports on charities that actively solicit for general public support. Based on public interest, including requests for information and search traffic on our website, BBB invites organizations to participate in an evaluation in relation to the 20 BBB Charity Standards.

This organization is tax-exempt under section 501(c)(3) of the Internal Revenue Code. It is eligible to receive contributions deductible as charitable donations for federal income tax purposes.

The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.On October 23, 2019, this organization agreed to pay $15,000 penalty as a result of its Narcotic Treatment Programs(NTP) failure to create and maintain records required by the Controlled Substances Act (CSA). The settlement resolves allegations that the business "NTP failed to conduct the required initial inventory of methadone at the new location. Furthermore, the NTP omitted material information on multiple forms required by DEA, which are used to order and track controlled substances. The forms omitted information such as quantity of packages ordered, date the containers were received, and the correct supplier. The lack of an initial inventory, combined with incomplete forms, made it difficult to determine whether diversion was occurring at the NTP. Diversion occurs when controlled substances are transferred from legitimate distribution channels to illegitimate distribution channels." Under terms of the settlement, the business agreed to pay the penaltyand create a new position for a registered nurse to oversee controlled substance dispensing at the NTP and is implementing a policy to enhance its compliance with the CSA recordkeeping requirements.This was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law. For more details, go to the United State Attorney's Office Northern Districts Press Release.In response, the charity provided the following statement:Since this matter was brought to our attention, St. Mary’s Healthcare has created a new position for a Registered Nurse to oversee controlled substance dispensing at the Narcotic Treatment Program (NTP) and has implemented a policy to enhance its compliance with the Controlled Substances Act (CSA) recordkeeping requirements. St. Mary’s promptly took actions to change its practices to enhance its compliance with CSA. St. Mary’s takes the potential for drug diversion very seriously and has implemented policies and procedures to track the NTP drugs and prevent any possibility of diversion in the future.
