AG Stein Joins Multi-State Lawsuit Against Twenty Generic Drug Companies
The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government’s allegations, which have not yet been proven.
On May 10, 2019, a coalition of 44 states have sued 20 generic drug manufacturers alleging a conspiracy to artificially inflate and manipulate prices, reduce competition and unreasonably restrain trade for more than 100 different generic drugs in violation of federal and state antitrust laws. A number of states also allege that the companies engaged in deceptive and/or unfair acts or practices in connection with the sale, offering for sale or advertising of these products in violation of state consumer protection laws.
The States involved are Connecticut, Alabama, Alaska, Arizona, Colorado, Delaware, Florida, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, Nevada, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, Tennessee, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin and Puerto Rico.
The lawsuit, filed in U.S. District Court for the District of Connecticut, also names 15 individual senior executive defendants who were allegedly responsible for sales, marketing, pricing and operations.
