Government Actions

Case No. 2020-MED-529; before the State of Montana Board of Medical Examiners in the Matter of John Carlbom, Advanced Emergency Medical Technician, Former License No. 2090

The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

 

On October 2, 2023, before the State of Montana Board of Medical Examiners, John Carlbom, Advanced Emergency Medical Technician, Former License No. 2090 entered into a Stipulation and Final Order. 

 

The Order alleges while working as the Director of Powell, EMS in Deer Lodge, MT, Carlbom, supervised three female EMTs whom he subjected to various forms of sexual harassment and sexual contact.  In addition to practicing emergency medical services (EMS) as an AEMT, Carlbom is the Chief Executive Officer (CEO) of Whiteline Consulting and Training (Whiteline). While assisting with and teaching Whiteline training courses, Carlbom subjected multiple students to sexual harassment and sexual contact.

 

The Board concluded that Carlbom’s verbal and written statements and physical contact with subordinate EMT employees he supervised and students taking his ECP training courses, as described above, constitute unprofessional conduct as sexual abuse, misconduct, and exploitation, under Admin. R. Mont. 24.156.2705(1)(m) (“commission of any act of sexual abuse, misconduct, or exploitation by the licensee whether or not related to the practice”).  Carlbom’s requests of students in his ECP training courses to defend his character in anticipation of allegations of “sexual harassment,” as described above, is interference to prevent a disciplinary proceeding or other legal action by harassment and inducement and constitutes unprofessional conduct under Mont. Code Ann. § 37-1-316(14) (“interference with an investigation or disciplinary proceeding by willful misrepresentation of facts, by the use of threats or harassment against or inducement to a client or witness to prevent them from providing evidence in a disciplinary proceeding or other legal action, or by use of threats or harassment against or inducement to a person to prevent or attempt to prevent a disciplinary proceeding or other legal action from being filed, prosecuted, or completed”).

 

Considering the findings, John Carlborn and the Board agreed to the following Sanctions:

 

1. Carlbom surrendered his Montana AEMT license issued by the Board, including all attached endorsements (Medications, Lead Instructor), as resolution of this matter and is thereby prohibited from practicing as an ECP in Montana. By accepting the surrender of Carlbom’s Montana AEMT license, the Board shall enter a Final Order revoking the license pursuant to Mont. Code Ann. § 37-1-312(1)(a).

 

2. Pursuant to Admin. R. Mont. 24.156.2701(1)(e) and 24.156.2720(4), Carlbom cannot serve as the Lead Instructor of an ECP course without an ECP license and endorsement.

 

3. Pursuant to Mont. Code Ann. § 37-1-314, Carlbom cannot petition the Board for reinstatement of his Montana AEMT license for 5 years from the date the Board’s Final Order is entered.

 

Carlborn waived his rights to a hearing. Carlbom desired to avoid unnecessary expenditure of time and other valuable resources to resolve this matter. Therefore, Carlbom voluntarily and knowingly waives the rights and elected to resolve this matter on the terms and conditions of this Stipulation and acknowledges that no promise, other than those contained in this Stipulation, and no threat or improper assertion has been made by the Board or Department or by any member, officer, agent, or representative of the Board or Department to induce Carlbom to enter into this Stipulation.

 

Carlborn waived his rights to a hearing. Carlbom desired to avoid unnecessary expenditure of time and other valuable resources to resolve this matter. Therefore, Carlbom voluntarily and knowingly waives the rights and elected to resolve this matter on the terms and conditions of this Stipulation and acknowledges that no promise, other than those contained in this Stipulation, and no threat or improper assertion has been made by the Board or Department or by any member, officer, agent, or representative of the Board or Department to induce Carlbom to enter into this Stipulation.
