On April 15, 2024, the business entered into an agreement with the Securities and Exchange Commission (SEC) to settle allegations that the business violated the pay-to-play rules for investment advisors, specifically that the business continued to received compensation from a government entity within two years after a campaign contribution to an elected official who had influence over the selection of investment advisers for services to the government entity, which included managing the assets of public pension funds. The SEC order finds that the business violated Section 206(4) and Rule 206(4)-5 of the Investment Advisers Act of 1940.
Under terms of the Order, the business agreed to cease and desist from committing or causing any violations and any future violations of Section 206(4) of the Advisers Act and Rule 206(4)-5 and to pay a civil penalty of $60,000.00 to the SEC within 10 days of the order.
