          California Department of Financial Protection and Innovation Memorandum of Understanding

          On January 22, 2021, the business entered into a Memorandum of Understanding with the California Department of Financial Protection and Innovation. The Assurance settles issues regarding the business offering earned wage advances and that California Consumer Financial Protection Law, section 90000 became effective on January 1, 2021. The Law requires regular reports from the business allowing the Department to evaluate the risks and benefits the business's advance pay program offers to California consumers. Under terms of the Assurance, starting April 1, 2021, the business agreed to provide the following information to the Department: payment volumes and summary of key contract terms describing payment amounts, number of payments, duration of the paybacks; and repayment, delinquency and default information. They will also provide information about the ratio of money advance to paychecks and frequency of the use of the advance pay product as well as the number and amounts of 'rollover' advance repayments to the next pay period. All fees paid by consumers will also be reported and information about California consumer complaints will be submitted.  The business also agreed to regular review of their records and agreed to follow best practices for their advance pay product.  The Assurance was for settlement purposes only and should not be considered as a finding of violation of the law.
