On November 15, 2023, the business entered into a Consent Order with the Minnesota Department of Commerce. The Consent Order settles allegations that the business used outdated information for consumers using their services, which resulted in incorrect information in real estate closing documents, closings checks being sent to incorrect or outdated addresses and title information, which contained sensitive personal data, being sent to the outdated addresses. In addition, is is alleged that the business attempted to 'pin the responsibility' for the missing checks on others and failed to reasonable supervise staff and made misstatements to consumers, real estate agents and other title companies. This demonstrated a violation of Minn. Stat. §§ 60K.43, subd. 1(8), 82.82, subd. 1(f), and 45.027, subd. 7(a)(4); § 82.82, subd. 1(d) and § 82.81, subd. 12(a)(9).
Under terms of the Consent Order, the business agreed to pay a civil penalty of $3,000.00 and to cease and desist from violating any laws, rules or orders under the authority of the Minnesota Department of Commerce, and to pay investigation costs of $225.00.
