On May 19, 2022, the Michigan Attorney General's Corporate Oversight Division sent Notice of Intended Action (NIA) to Opulent Marketing, Inc d/b/a Infinite Auto Protection. The Notice alleges “IAP/Opulent has not lived up to the terms of its own contract”.
The NIA cites evidence from consumer complaints that “consistently raise the following concerns”:
1. Claims process misrepresentations. IAP represented that it “guarantees 100% payment of all covered repairs” and offers “fast 24/7 claims process”. Consumer complaints indicated IAP claims process is difficult, time-consuming, and replete with delay.
2. Contract cancellation refund misrepresentations. IAP’s website represented “100% Risk Free” and “30 days money back guarantee on all vehicle services contracts”. An unknown number of service contracts contain conflicting refund cancelation provision. IAP has construed the contract in its own favor, utilizing the provision resulting in a smaller refund amount owed to the consumer.
3. Non-payment of cancellation refunds. Most (and increasingly all) complaints report IAP’s failure to pay cancellation refunds. Repeated calls and emails by consumers are met with silence, or a response that the refund is “in process”.The Notice invites the business to explore a voluntary assurance agreement to avoid further investigation or litigation.
