Pending Government Action
The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government's allegations, which have not yet been proven.

On 3/24/2020 the Michigan Attorney General sent a Notice of Intended Action against Frequency Apps Corp. and Biores Technologies, Inc. Both companies are operated by Adam Petty, who also runs My HCG Way. These companies are affiliated with www.frequencyapps.com, which advertised a product for sale called the Coronavirus Defender. The website claimed, "Are you looking to prevent the Coronavirus? The COVID-19 Defender is designed to be used as a preventative measure against the Coronavirus disease 2019 (COVID-19). The patch is placed on the upper left side of the body (shoulder, upper left arm, left chest) and exchanged every three days. For the best results, continue to use the Defender until the likelihood of contracting the COVID-19 virus is gone. If you have already contracted the virus, The COVID-19 Defender patch can be worn at the first sign of symptoms. If symptoms are already present, wear at 2 patches (1 on the left & 1 on the right), changing them every 3 days, continue with 2 patches until symptoms are no longer present." It went on to state, "So why the panic? Well for one COVID-19 is spreading faster than the Swine Flu (H1N1) did in 2009, no vaccine has been created, and the media is fueling the flames of fear. That is why we developed the COVD-19 Defender, to help relieve your concerns and fears about getting the virus.".

The Michigan Attorney General alleges these claims violate the Michigan Consumer Protection Act. The company has been ordered to Cease and Desist.

BBB has also identified concerns about these unsubstantiated health claims regarding this patch and the coronavirus.

As of 3/24/2020 the company website has been replaced with a message that the site is "undergoing maintenance". BBB has attempted to contact the company for response to these concerns over the product and advertising, but as of 3/24/2020 has not received a response.

Products and Services
This company offers alternative retail medicine such as foot baths, allergy tests, and HCG patches as well as homeopathic medicine and massage. The company website indicates it is a BioRes Technologies Company.

Government Action

The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

On April 15, 2020 the Michigan Attorney General, Frequency Apps and Biores Technologies finalized an Assurance of Voluntary Compliance and Discontinuance in Ingham County Circuit Court. Under the agreement, Frequency Apps and Biores Technologies agreed to stop marketing and selling the Coronavirus Defender Patch. The Michigan Attorney General has alleged the Coronavirus Defender Patch marketed by the company violated the Michigan Consumer Protection act by misleading consumers about its use to treat or protect against Coronavirus. BBB reports on known significant government actions involving business' marketplace conduct. BBB has attempted to contact the company, but has not received a response. The agreement filed in Ingham County Circuit Court can be found at https://www.michigan.gov/documents/ag/Frequency_Apps_AVC_final_687261_7.pdf.
