BBB reports on known government actions involving business’ marketplace conduct. The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved.  We are providing a summary of the government's allegations, which have not yet been proven:

On September 13, 2018, the Attorney General Curtis Hill filed a lawsuit against multiple defendants, including BWI Equipment, Inc. According to the complaint, the defendants have engaged in a variety of schemes intended to subvert the laws of State of Indiana related to the sale of motor vehicles. The complaint alleges that the defendants sold motor vehicles without a license, misrepresented vehicle mileage in advertising, altered the odometers on motor vehicles, failed to deliver titles to consumers, and listing fictitious sale prices on consumer bills of sale. Additionally, the complaint alleges that the defendants engaged in a scheme to pay a police officer to illegally sign off on repairs made to salvage vehicles without inspection, and subsequently sold the vehicles through retail dealerships. In response to these charges, the business provided the following statement to the BBB on October 2nd, 2018:

In the lawsuit filed on September 13, 2018, BWI Equipment, Inc is only one of multiple defendants named in the complaint. There are seven separate defendants in the lawsuit, who are each accused of individual specific alleged violations of Indiana law. BWI Equipment Inc. has not been accused of any of the very serious ad specific violations mentioned in the BBB letter of September 17th, 2018, which were all alleged against other defendants. Review of the entire complaint will confirm that the following statements are accurate and true. BWI Equipment, Inc has never been accused nor has it ever sold a motor vehicle without possession of a dealer's license. BWI Equipment, Inc has never been accused or ever misrepresented vehicle mileage nor altered odometers on any motor vehicle. BWI Equipment, Inc has never been accused or ever failed to deliver a title to a consumer nor listed a fictitious sale price on a consumer's bill of sale. BWI Equipment, Inc has never been accused of or ever participated in any scheme to pay police officer nor sold any salvage vehicles to other retail dealerships. BWI Equipment, Inc has been in the retail used vehicle and equipment sales business, complaint free, for nearly thirty (30) years. BWI Equipment, Inc has built this operation upon a solid foundation that relies heavily on repeat sales and satisfied customer referrals. BWI Equipment, Inc is name in very narrow and subordinate provisions of the complaint. BWI Equipment is vigorously defending its position on the very few specific accusations reflected in the complaint.
