State of Idaho Contractors Board vs Aztec R&R LLC
The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.
On December 15, 2021, Before the Contractors Board State of Idaho, Aztec R&R LLC ("Respondent") and the State of Idaho entered into a final finding of fact, conclusions of law and final order.
According to the Order, on November 14, 2017, Respondent first registered as a contracting entity in Idaho. On November 15, 2018, Respondent’s registration expired. Respondent has not renewed its registration. After its registration expired, Respondent continued to engage in the practice of contracting. The Order states Respondent was charged with Count 1, the Unregistered Practice of Contracting. The allegations set forth in Count I constitute a violation of the following laws governing the practice of contracting in the State of Idaho: Idaho Code §§ 54-5204(1), stating that it is unlawful for any person to engage in the business of contracting or to hold himself out as a contractor in Idaho without being registered with the Board; and 54-5215(2)(a) violations of the Idaho Contractor Registration Act.
On or around October 4, 2019, Respondent entered into a $3,200.00 contract with Complainant whereby Respondent agreed to perform construction work for Complainant. In entering into the contract, Complainant paid Respondent a $1,200.00 down payment. Respondent never performed any construction work for Complainant and never returned Complainant’s down payment. The Order states Respondent was charged with Count 2, Dishonest or Dishonorable Dealings. The allegations set forth in Count II constitute a violation of the following laws governing the practice of contracting in the State of Idaho: Idaho Code §§ 54-5215(2)(g), dishonest or dishonorable dealings; and 54-5215(2)(a), violating the Idaho Contractor Registration Act.
This Order was created by the Board due to the Respondent’s failure to answer, appear, or otherwise defend in this matter. The factual allegations set forth in the formal Complaint against Respondent are deemed true and, as a result, no formal hearing was held or necessary. The Board hereby orders as follows:
1. Respondent shall not engage in the business of contracting in Idaho without registering as required by Chapter 52, Title 54 of the Idaho Code.
2. Respondent’s registration, RCE-44643, including any potential right of reinstatement of renewal, is hereby revoked.
3. Respondent shall pay a fine in the amount of $2,000.00. The fine shall be paid within ninety (90) days from the date of this Order.
4. Respondent shall pay the costs and attorney fees incurred in the investigation and prosecution of this matter. I.C. § 67-2602.
