BBB has received the following complaint regarding the marketplace practices of BTR Consulting:
Received Random phone call over 3 week time period for a payment for a debt which I cannot verify I owe. Money was demanded stated they bought debt from HSBC I have documentation from HSBC that there is no debt in my name. Sadly I paid this not knowing it was a scam/fraud. They were calling my deceased fathers home with a robo call which then I asked for that to stop and then they started pursuing me for money for a platinum mastercard. EAch week it was a different person saying I didn't talk to them the week before. I couldn't even get a company name until they sent me a letter on 12/3/19 by email which I provided to them they refused to use postal mail and send anything legitimate or proof of charges/debt. Company is a scam and needs to be investigated for defrauding ppl.
BBB respectfully requested B T R Consulting's response to the consumer's allegations.
BBB requested answers to the following questions:
1. The address on file for your firm is a post office box. Please provide the full physical address for your firm.
2. The telephone number provided is a number from Phoenix, Arizona. Please clarify.
3. Is B R T Consulting affiliated with any other firms? If so, please provide all company names and locations.
4. Is BRT Consulting affiliated in any way with HSBC? If so, please provide information showing such.
5. In what states is BRT Consulting licensed to do debt collections?
6. Has BRT Consulting been affiliated with McLeodusa Telecommunications at any time? If so, please provide clarification.
7. BBB was not able to find any corporate registration for your firm in the state of Georgia. Please provide your company's corporate registration.

Also requested were copies of any written agreements, contracts, literature, brochures and marketing materials used by B T R Consulting.
BBB received return mail from B T R Consulting. At this time we are unable to determine if the company is in operation.

What practices are debt collectors prohibited from using?
Harassing or abusive tactics. Debt collectors may not:
use or threaten to use violence or criminal means to harm you, your reputation or your property;
use obscene or profane language;
advertise that you owe a debt;
advertise your debt for sale;
telephone you, or cause a telephone to ring,
repeatedly or continuously with the intent to annoy or harass; or
place telephone calls without meaningful disclosures of their identity.
False or misleading representations.
Debt collectors may not misrepresent the truth. A debt collector cannot pretend to be anyone except a debt collector. The collector must tell the person who allegedly owes the debt that the debt collector is trying to collect the debt and may not deceive you by:
using a false company or creditor name;
implying the communication is from anyone other than a debt collector;
misrepresenting the amount of the debt;
threatening to disseminate false credit information about you;
representing falsely that they are government representatives;
threatening legal action that is illegal or that they do not intend to take;
representing falsely that you have committed a crime or that you will be arrested or imprisoned;
implying falsely that the debt collector is employed by a credit bureau;
implying falsely that they are attorneys or that an attorney is involved in the collection of the debt;
indicating falsely the legal status of papers or forms sent to you;
using any words or symbols in their notices to make the person who allegedly owes the debt think the notices are legal documents when they are not; or
sending you something that resembles an official document from a court or governmental agency.
Other prohibited unfair practices.
Debt collection agencies may not:
collect an amount greater than what you owe;
deposit a postdated check prior to the date on the check;
communicate with you about a debt by postcard;
use envelopes that reveal information indicating that the sender is a debt-collection agency;
cause you to incur a communication expense, such as a collect telephone call charge, telegram fee, wire fee, or other similar charge, through the concealment of the true purpose of the communication; or
garnish your wages or take your home or possessions without a court judgment. (An exception exists for federally guaranteed student loans that are in default.)
What information must a debt collector provide me?
Within five days after the first time a debt collector contacts you by phone or in writing, the debt collector must send in writing a notice telling you:
the amount of money you owe;
the name of the original creditor with whom you incurred the debt;
that unless you dispute the validity of the debt, or any part of the debt, within 30 days of the date you receive the notice, the debt will be assumed to be valid;
that if you notify the debt collector in writing that you dispute all or part of the debt within those 30 days, the debt collector must mail you a copy of a verification that you owe the debt; and
that the debt collector will provide you the name and address of the original creditor, if different from the current creditor and if you so request.
