The Federal Trade Commission having initiated an investigation of certain acts and practices of First American Title Lending of Georgia and having been furnished with a copy of the draft complaint that the Bureau of Consumer Protection proposed to present to the Commission would charge First American Title Lending of Georgia with violating the provisions of the Federal Trade Commission Act and the Truth in Lending Act, appearing to the Commission that this proceeding is in the public interest, Alleges:
Failure to Disclose Terms of the Loan
The FTC alleged First American Title Lending of Georgia ads lured consumers in with the promise of "zero" interest, but then failed to clearly and conspicuously disclose hidden conditions attached to those eye catching deals. First American Title Lending touted 0% interest in large headlines on websites, billboards, newspaper ads, yard signs and elsewhere.
What consumers were not clearly told was that they'd only get the 0% rate if they were new customers, if they paid by money order or certified funds and if they paid in full within 30 days. The company failed to disclose that unless a loan was paid in full in 30 days, the zero percent offer did not apply, and that a borrower would have to pay a finance charge for the initial 30 days of the loan in addition to any finance charges incurred going forward.
First American Title Lending also failed to disclose how much the finance charge would cost a borrower after the 30-day introductory period was over.
First American Title Lending of Georgia LLC is a limited liability company with its principal place of business at 6045 Century Oaks Dr, Chattanooga, Tennessee 37416. First American Title Lending of Georgia LLC operates from 33 different locations in Georgia.
Under the consent orders, First American Title Lending is prohibited from failing to disclose all the qualifying terms associated with obtaining a loan at its advertised rate and what the finance charge will be after an introductory period ends; and from misrepresenting any material terms of its loan agreements.
This order will terminate on June 2, 2035 or 20 years from the most recent date the FTC files a complaint in federal court alleging any violation of the order.
