On May 14, 2024, First Choice Processing, Inc and related companies owned by Durand Kelby Tovar, entered into a consent judgment with Colorado Attorney General, Phil Weiser.
This settlement comes after an investigation found that Tovar had been going door-to-door asking for donations in order to send care packages to members of the military. Tovar had been representing himself as a charity, when, in fact, his entity was not registered with the State of Colorado nor was he registered as a paid solicitor as legally required.
The investigation further found that Tovar sent very few actual care packages, instead pocketing the majority of the funds he collected.
The consent judgment bans Tovar from engaging in any direct or indirect charitable activities and also requires that he pay a fine in the amount of $20,000.
