Ad Review

On September 23, 2020, BBB Serving Los Angeles and Silicon Valley requested that Vitalize Hair substantiate, modify, or discontinue online advertising claims to comply with BBB advertising standards.

The BBB Code of Advertising states, "1.1 The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any claims or offers made before publication or broadcast and, upon request, present such substantiation promptly to the advertising medium or the Better Business Bureau."

The BBB Code of Advertising also states that "37.1 "Made in USA" and similar terms used to describe the origin of a product must be truthful and substantiated. 37.2 An advertiser must not express or imply that a product or product line is exclusively "Made in USA" unless all or virtually all of the product is made in the U.S. All significant parts and processing that go into the product must be of U.S. origin. That is, the product should contain no -- or negligible -- foreign content. 37.3 Advertisers can refer to products that are manufactured with foreign components as "Assembled in USA," if the product's principal assembly and last substantial transformation was completed in the U.S. 37.4 Qualified "Made in USA" claims, for example, "60% U.S. content," "Made in U.S. of U.S. and imported parts," are appropriate for products that are manufactured or have been substantially assembled domestically. However, advertisers must avoid making these claims if a significant amount of assembly or material of the product was not completed in the U.S. Qualified "Made in USA" claims, like unqualified claims, must be truthful and substantiated."

Additionally, Section 34 of the BBB Code of Advertising states, "34. Claims relating to performance, energy savings, safety, efficacy or results for a product or service should be based on recent and competent testing or other objective data."

A sample of some of the advertised claims for which BBB requested substantiation, modification, or discontinuation are:

- "Stimulates the hair follicles and is clinically proven to promote thicker and fuller hair."

Our treatment is a fantastic choice for both men and women, as it is safe and all-natural. The secret is Redensyl(r), our acclaimed and scientifically formulated compound, which encourages the growth of thicker hair."

As of October 16, 2020, the business has failed to respond to our request for substantiation, modification, or discontinuation of the advertised claims.

Investigations

The BBB opened an investigation on this firm due to the amount of inquiries we have received. According to BBB files, consumers allege not receiving the purchases they paid for. Furthermore, consumers allege not being able to get a response with the details of their orders or refunds. On September 10 and October 5, 2020 the BBB contacted the company in regards to our concerns about the amount and pattern of complaints we have received, unfortunately, the BBB did not receive a response.

The Federal Trade Commission's Prompt Delivery Rules "spells out the ground rules for making promises about shipments, notifying consumers about unexpected delays, and refunding consumers' money. Enforced by the FTC, the Mail or Telephone Order Rule applies to orders placed by phone, fax or the Internet."
