On September 18, 2020, BBB investigated Modern Art Home’s business practices. This investigation was prompted by consumer complaints and reviews. These reviews shared concerns regarding the business failing to honor their refund, returns, and exchange policy.
BBB reached out to the business by email on September 18, 2020, requesting the following information be provided to BBB:
- Details regarding how customers can reach the business if they require assistance
- Details regarding the fulfillment of customer orders
- Details regarding how consumers can have the refund, returns, & exchange policy honored.
- Please clarify or amend the refund, returns, & exchange policy as currently every product on your website is currently listed for sale. Your policy currently states, "Not applicable to sale items. ALL SALES ARE FINAL SALES."
BBB also sent the company an SBQ (Standard Business Questionnaire) form to obtain more information on the business, its structure, management, etc., however the business failed to return the form.
Additionally, BBB requested Modern Art Home to modify, substantiate, or discontinue claims on their website that read: “#1 RATED BEAN BAG FOR POSTURE AND COMFORT.” and featured endorsements by major media outlets, Buzzfeed, NBC News, Hallmark Channel, and HuffPost. Advertisers must be prepared to substantiate such claims per BBB's Code of Advertising.
BBB's Code of Advertising Section 1 states, advertisements should be truthful, sincere offers to sell. Advertisers have a responsibility to have substantiation for all claims made and should be able to provide that substantiation upon request. Code of Advertising Section 2 states, When comparing prices to one’s own former selling price, current price of others, list prices, wholesale prices, or to items which are imperfect, it is important to make sure that consumers have all the necessary information to make an informed purchase.
Code of Advertising Section 28 states, superlative statements in advertisements about the tangible qualities and performance values of a product or service are objective claims for which the advertiser must possess substantiation as they can be based upon accepted standards or tests. As statements of fact, such claims, like “#1 in new car sales in the city,” can be proved or disproved. Code of Advertising Section 30 states, advertisers should ensure that testimonials and endorsement are not misleading and represent the current opinion of the endorser. A consumer endorser’s experience should reflect what users generally achieve, unless there is a clear and conspicuous disclosure of what the expected results will be. Advertisers should not include claims in testimonials that they themselves cannot make and support.
