Vital Gear USA is making the following claim on the individual product pages advertised on their website, vitalgear.us:
"100% Money-Back Guarantee Included Feeling Uncertainty? Don't Worry, We Have You Covered With Vital's 100% Money-Back Guarantee. Making Our Customers Happy Is Our #1 Priority. If You Are Ever Unsatisfied, Contact Support And We Will Make Things Right Immediately. Even At Our Own Expense."
This is in contradiction to the company's Refund & Return policy found here: vitalgear.us/pages/refund-return-policy. According to the policy:
"The Vital Guarantee is included on all orders that have the Guarantee listed in the description. These products may be returned for up to 30 days if the product is "not as described", "unuseable", or "in damaged condition upon receiving". The Vital Guarantee does not cover returns of items you simply no longer want, due to the COVID-19 Impact. We are unable to process used items as returns per state law, unless they meet the above criteria."
According to the BBB Code of Advertising, "Advertisers should only use “satisfaction guarantee,” “money back guarantee,” “free trial offer,” or similar representations in advertising if the seller or manufacturer refunds the full purchase price of the advertised product or service at the consumer's request;" and, "Sellers or manufacturers should advertise that a product or service is warranted or guaranteed only if the seller or manufacturer promptly and fully performs its obligations under the warranty or guarantee."
BBB wrote to the company on August 24 and August 31, 2021 requesting that they either remove the "100% Money Back Guarantee" or, if they do honor the guarantee, that they remove the webpage outlining the stipulations placed on the guarantee. As of today's date Vital Gear USA has not responded.
