The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.
On May 13, 2024, Nan McKay & Associates entered into a Settlement Agreement with the United States Department of Justice. The Settlement Agreement settles allegations that the business was a subcontractor for the Emergency Rental Assistance Program and was responsible for delivering and maintaining technology products used by New York residents to fill out and submit forms requesting financial assistance during the Covid-19 pandemic, and was responsible for testing the security of the technology prior to launching it to the public. The business admitted to not satisfying the obligation to complete the cyber security testing and the program was shut down 12 hours after launch, due to certain applicants' personal identifiable information being compromised. Under the terms of the Settlement Agreement the business agreed to pay a total of $3,700,000 of which $1,125,000 is restitution.
