On May 11, 2020, BBB investigated UptownFab’s business practices. This investigation was prompted by a large volume of customer complaints, negative customer reviews, and scam tracker reports. Customers alleged that after placing an order through the company website they were experiencing a delay of weeks, months, and many alleged of never receiving their product. Some customers also reported a poor customer service experience as customer emails to the company were returned with a generic response or no response at all.
On May 14, 2020, BBB sent an email to UptownFab asking the business to address the following:
- Details regarding the fulfillment of customer orders and refund policy
- Documentation of the business's registration in the State of Arizona
Additionally, BBB requested UptownFab to modify, substantiate, or discontinue claims on their website (https://uptownfab.com/), that read: "24/7 Support"; "#1 Rated Waist Trainer"; "Increases Metabolism", "Breaks Up Fat Cells", "Directly Reduces Fat Reserves". BBB also requested substantiation for comparison pricing listed on their website.
According to BBB's Code of Advertising, it requires that advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB. Advertisements which are untrue, misleading, deceptive, fraudulent, falsely disparaging of competitors, or insincere offers to sell, shall not be used. Additionally, BBB’s Code of Advertising Section 34 of the Code requires that claims relating to performance and results should be backed up by reliable evidence.
BBB made multiple attempts to contact the business but did not receive any returned communication. Through an investigation, BBB also sent the company a Standard Business Questionnaire form, however the company failed to return the form.
BBB also attempted to contact the company by phone but the automated voice message directs callers to send an email to support@uptownfab.com.
Before you place an online order make sure to review the company’s website, see if there is any negative information about the company, or check to see if BBB has any complaints reported. Also, check the website for contact information such as phone numbers, emails, and mailing addresses. Consumers want to make sure the company can be easily contacted if any issues may arise.
Consumers with outstanding concerns are still encouraged to file a complaint for BBB records, but may also wish to contact their local Attorney General's Office, and/or file a complaint with the Federal Trade Commission.
