The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.
On February 22, 2021, Arizona Public Service Company entered into a Consent Agreement with the Arizona Attorney General, which is pending approval. The Consent Agreement settles allegations that the business's communications to its customers regarding their rate plans did not inform customers adequately regarding the benefits of switching to their most economical plan. In addition, some consumers may have been impacted by the data error in the 2017 letters. Under terms of the agreement, the business agrees to restitution totaling $24,000,000, this is in addition to the amounts that may have been previously remitted by the business to its customers for restitution prior to the proceedings. The business also agrees to pay $200,000 to cover the state's cost of the investigation, and $550,000 to promote the Attorney General Office's consumer and community outreach awareness and prevention program. The Assurance was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law.
