On March 9, 2020 the Consumer Financial Protection Bureau filed a complaint in federal court. Charges filed allege the business is in violation of federal law prohibiting opening deposit accounts in consumers’ names; transferring funds from consumers’ existing accounts to new, improperly opening accounts; issuing credit cards; enrolling consumers in online-banking services; and opening lines of credit on consumers’ accounts without consumers’ knowledge or consent.
Fifth Third’s conduct violated the Consumer Financial Protection Act of 2010 (CFPA), the Truth in Lending Act (TILA), the Truth in Savings Act (TISA), and their implementing regulations.
The matter is pending.
