On January 31, 2020, in the Circuit Court of Pulaski County, the Arkansas Attorney General's Office obtained a Judgment Order against Jonathan Funk and his company Jonathan Funk Photography, LLC for violations of the Arkansas Deceptive Trade Practices Act ("ADTPA").
It is a violation to engage in unconscionable, false, or deceptive acts or practices in business, commerce, or trade. Defendants have engaged in prohibited conduct by; a.) Advertising services they had no ability or intent to perform, b.) Collecting money in full with no ability or intent to deliver a final product, c.) Promising consumers delivery of final product with no intention of delivery, d.) Failing to refund consumers' money; and e.) Capitalizing on the emotional importance of precious moments in families' lives to collect money for goods and services Defendants had no intent or ability to perform.
The Order states the LLC is to pay $98,625.00 in restitution, $100,000 in civil penalties, $1,135 in court costs, and to transfer images to consumers. For more details go to http://bbb.org/h/jzzo.
